Your legal obligations as a duty holder
If you own, manage, or are responsible for the maintenance of a non-domestic building built before 2004, you have a legal duty to manage asbestos on those premises. This is not optional and it is not subject to the size of your building or business.
Under the Safety, Health and Welfare at Work (Exposure to Asbestos) Regulations 2006–2025, you are required to have a Management Survey carried out, an asbestos register maintained, and an Asbestos Management Plan in place. The condition of any identified asbestos must be reviewed by a competent person on an annual basis.

If you rent out a commercial property, the duty to manage asbestos sits with whoever manages the maintenance and repair of the building. If that is you, you are the duty holder. If a tenant takes on that responsibility contractually, it is essential this is clearly established in writing.

Asbestos Management Plan
A live document that records what is present, its condition and risk rating, and how it will be managed, monitored, and communicated to anyone working on the building.
Step 3
Annual Re-Inspection
A periodic check by a competent person to confirm that identified ACMs remain in a stable condition and that your register and plan remain current and accurate.
Planning building work?
If any refurbishment, renovation, or structural work is planned on your premises, a Management Survey alone is not sufficient. You will need a Refurbishment and Demolition Asbestos Survey (RDAS) before work begins — regardless of whether a Management Survey has already been done.
